Creditors’ Rights
Yes, creditors do have rights too, and our firm has experience
in representing all types of creditors.
The bankruptcy process is designed, in the interest of fairness,
to classify creditors based upon the specific type of debt owed
to them by the bankruptcy debtor. Secured creditors, i.e. those
creditors who hold a lien on collateral to secure repayment of
the debt owed them, are typically in the strongest position.
“Administrative,” “Priority Unsecured,” and Special Class”
creditors also receive preferential treatment. “General
Unsecured” creditors hold the lowest priority.
